Upon receipt of the package, the Customer is asked to check the apparent condition of the package and the Products.
In the event of a damaged, opened, incomplete, or visibly damaged package, the Customer is asked to file a claim with the carrier and promptly contact customer service.
This verification does not deprive the Customer of their rights under legal guarantees. No clause in these Terms and Conditions limits the Customer's rights arising from the legal guarantee of conformity or the guarantee against hidden defects.
---
## 9. Right of Withdrawal
### 9.1 Principle
For Orders placed remotely on the Website, the Customer has a period of fourteen days to exercise their right of withdrawal, without having to justify their decision.
For sales of goods, the period begins on the day the Product is received by the Customer or by a third party designated by them, other than the carrier.
In the case of an Order for several Products delivered separately, the period begins on the day the last Product is received.
### 9.2 Exercising the Right of Withdrawal
To exercise their right of withdrawal, the Customer must notify the Seller of their decision to withdraw before the expiry of the fourteen-day period.
The Customer may use the standard withdrawal form at the end of these Terms and Conditions, or any other unambiguous statement expressing their intention to withdraw.
The request can be sent:
* by email to: [contact@footkorner.com](mailto:contact@footkorner.com);
* or by mail to: FOOTKORNER / FK WEB – Customer Service, 99 boulevard de la Reine, 78000 Versailles, France.
Simply returning the Product without notifying us of your withdrawal is not necessarily sufficient to constitute exercising your right of withdrawal.
### 9.3 Returning Products
The Customer must return the Product no later than fourteen days after notifying us of their decision to withdraw.
The Customer is responsible for the direct costs of return shipping, unless the return is due to an error attributable to the Seller or otherwise specified by the Seller.
Products must be returned complete, clean, unwashed, unworn beyond a brief fitting, with their tags attached, and, where possible, in their original packaging.
The Customer may be held liable for any diminished value of the Product resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the Product.
### 9.4 Exceptions to the Right of Withdrawal
In accordance with applicable regulations, the right of withdrawal may be excluded in particular for:
* Products made to the Customer's specifications or clearly personalized;
* Products unsealed after delivery and which cannot be returned for hygiene or health protection reasons;
* Products that are damaged, incomplete, or used beyond a simple fitting, when such use results in a diminished value of the Product.
These exceptions are applied within the limits provided by law.
---
## 10. Refund in case of withdrawal
If the right of withdrawal is validly exercised, the Seller will refund the Customer all sums paid, including the initial delivery costs corresponding to the standard delivery method offered by the Seller.
If the Customer chose a more expensive delivery method than the standard delivery method offered, the additional cost will not be refunded.
The refund will be issued no later than fourteen days from the day on which the Seller is informed of the Customer's decision to withdraw.
For sales of goods, the Seller may withhold reimbursement until the Products have been received or until the Customer has provided proof of shipment of the Products, whichever is the earlier.of these facts.
The refund will be issued using the same payment method used by the Customer when placing the Order, unless the Customer expressly agrees to another method of reimbursement and provided that this refund does not incur any costs for the Customer.
Promotional codes, commercial discounts, and non-monetary benefits are not eligible for cash refunds.
---
## 11. Returns Outside the Right of Withdrawal
The Seller may offer, as a commercial incentive, return or exchange options in addition to the statutory right of withdrawal.
These options are indicated on the Returns, FAQ, or Customer Service communications pages.
These commercial incentives never limit the Customer's legal rights, including the legal guarantee of conformity and the guarantee against hidden defects.
---
## 12. Legal Guarantees
All Products sold on the Site are covered by applicable legal guarantees, independently of any commercial guarantee that may be offered.
The Customer benefits in particular from:
* the legal guarantee of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code;
* the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
### 12.1 Information Box on Legal Guarantees
The consumer has two years from the delivery of the goods to invoke the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to prove the existence of the lack of conformity, not the date on which it appeared.
When the sales contract for the goods provides for the continuous provision of digital content or a digital service for a period exceeding two years, the legal guarantee applies to this digital content or digital service throughout the entire provision period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of their request, free of charge and without significant inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods, but the seller insists on replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by receiving a full refund upon return of the goods, if:
1. the professional refuses to repair or replace the goods;
2. The repair or replacement of the goods takes place after a period of thirty days;
3. The repair or replacement of the goods causes significant inconvenience to the consumer, particularly when the consumer ultimately bears the costs of taking back or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;
4. The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to cancel the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining warranty period until the goods are delivered in good condition.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of their average annual turnover.
**The consumer also benefits from the legal guarantee against hidden defects, pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles you to a price reduction if the item is kept or to a full refund upon return of the item.**
To request the application of a legal guarantee, the Customer may contact the Seller at: [contact@footkorner.com](mailto:contact@footkorner.com).
### 12.2 Legal Guarantee of Conformity
The Seller is liable for any lack of conformity existing at the time of delivery of the Product, under the conditions stipulated by the Consumer Code.
In the event of a lack of conformity, the Customer may request that the Product be brought into conformity by repair or replacement, subject to the cost and feasibility conditions stipulated by law.
When repair or replacement is impossible, refused, or cannot be implemented under the conditions stipulated by law, the Customer may request a price reduction or cancellation of the sale.
### 12.3 Warranty Against Hidden Defects
The Customer may also invoke the warranty against hidden defects when the Product has a hidden defect that renders it unfit for its intended use, or that so diminishes its usability that the Customer would not have purchased it, or would have paid a lower price, had they been aware of the defect.
Actions arising from hidden defects must be brought within two years of the discovery of the defect.
In this case, the Customer may choose between rescinding the sale or obtaining a price reduction.
---
## 13. Commercial Warranty
Unless otherwise specified on the product page or in a separate document, the Seller does not offer any commercial warranty separate from the statutory warranties.
Any commercial warranty offered by a manufacturer or brand applies according to the terms and conditions defined by the manufacturer or brand in question, without limiting the statutory warranties owed by the Seller.
